ITEM 1 MASTER CASE NO. 09-094, UNIFIED DEVELOPMENT CODE AMENDMENT 09-004

Location: Affects property Citywide
Request: This is a request to amend the Unified Development Code (UDC). Various sections of the UDC will be amended to clarify the intent of the UDC as it relates to ongoing Community Preservation efforts
Recommendation: Staff recommends the Planning Commission continue the item to a date uncertain.

ITEM 2 MASTER CASE NO. 09-115, CONDITIONAL USE PERMIT 09-013

Applicant: New Cingular Wireless PCS, LLC
Location: 25775 McBean Parkway, APN 2861-036-011
Request: The applicant is requesting a Conditional Use Permit to allow for the installation and operation of a wireless telecommunication facility located on an existing commercial building. The project consists of twelve (12) panel antennas and eight (8) equipment cabinets to be placed behind parapet walls designed to match the building. The property is located at 25775 McBean Parkway in the Residential Low (RL) zone in the community of Valencia.
Recommendation: Staff recommends the Planning Commission adopt Resolution P09-31, approving Master Case 09-115, Conditional Use Permit 09-013 to allow for the construction of a wireless telecommunications facility upon an existing medical office building located at 25775 McBean Parkway (APN: 2861-036-011) subject to the attached Conditions of Approval (Exhibit A).
ITEM 3 MASTER CASE NO. 06-302, VESTING TENTATIVE TRACT MAP 68601, Hillside Review 06-015

Applicant: Canyon Brook LLP
Location: Northern terminus of Oak Spring Canyon Road and Sam Place
(APN: 2837-001-016)
Request: The applicant is requesting the approval of a Vesting Tentative Tract Map (VTTM) for the creation of thirty-five (35) new single-family lots, two (2) open space lots, and two (2) debris basin lots on a forty-eight (48) acre parcel of land located at the terminus of Oak Spring Canyon Road and Sam Place (APN 2837-001-016). The applicant is also requesting the approval of a Hillside Review Permit to develop upon the vacant project site, which has an average cross slope greater than 15%. The property is zoned RS (Residential Suburban) with a General Plan designation of RS.
Recommendation: Staff recommends the Planning Commission open the public hearing, receive testimony from the public, and adopt Resolution P09-26, adopting the Mitigated Negative Declaration and approving Master Case 06-302 including Vesting Tentative Tract Map 68601 and Hillside Review 06-015, subject to the attached Conditions of Approval (Exhibit A).
